Reproductive Loss
Beginning January 1, 2024, All employees may be eligible for up to five days unpaid leave following a reproductive related loss. This leave is separate from other leaves offered to employees for their serious illness or to care for a family member with a serious illness.
What Is a Reproductive Loss Event?
A reproductive loss event is defined as the final day of any of the following:
- Failed adoption
- Failed surrogacy
- Miscarriage
- Stillbirth
- Unsuccessful assisted reproduction
Leave Details
- Employees may take up to five days per event, with a maximum of 20 days within a 12-month period.
- Leave days do not need to be consecutive.
- Leave must be completed within three months of the reproductive loss event.
- If the employee is on another type of leave (e.g., Pregnancy Disability Leave or CFRA), the reproductive loss leave must be taken within three months after that leave ends.
- Employees may use available vacation, personal holiday, sick leave, or compensatory time off in lieu of unpaid.
Some reproductive loss events, such as miscarriages and stillbirths, may also be covered by bereavement leave.
