Proposition 57, approved by two-thirds of the California electorate last November, changes California law in three ways, with the aim of further reducing the California state prison population: (1) certain "non-violent" offenders sentenced to lengthy prison sentences will become automatically eligible for a hearing before the California parole board for possible early release; (2) judges, not prosecutors, must now decide in each case whether children between the ages of 14 and 17 years old should be tried as adults instead of juveniles; and (3) additional custody reduction credits may now be made available to all state prisoners as awards for completion of education and self-help programs.
This presentation will summarize the key points of the law, discuss its implementation, and examine some of the political commentary and case law that has emerged from its passage.
